MCA vide Notification No. G.S.R. ………(E) on Thursday, 27th July, 2017, has notified the Companies (Incorporation) 2nd Amendment Rules, 2017 which shall come into force on the date of publication in Official Gazette.
Vide said notification the following rules have been amended:
- Rule 28: Shifting of Registered Office within the same State, from one ROC to another: wherein documents has been listed which are to be submitted along with application to Regional Director for shifting of Registered Office.
- Rule 30: Shifting of Registered office from one state or union Territory to another state; wherein list of documents accompanying application to Central Govt. has been amended. Also provisions relating to newspaper advertisement has been amended stating that it shall be made no more than 30 days before filing application in Form INC-23 (previously was at least 14 days before date of hearing).
- Form INC-23: Application to Regional Director for Shifting RO and Form INC-26: Advertisement in newspaper for shifting have been amended.
