MCA vide Notice on Monday dt. 19th December, 2016 stated that existing Incorporation Forms INC-2 & INC-7 are likely to be withdrawn shortly. After such withdrawal, incorporation of all companies including Section 8 Companies (except Part I Companies, a company having more than 7 subscribers/promoters, or foreign national subscribers not having a valid DIN) have to use only SPICe forms i.e. SPICe (INC-32), SPICe eMoA (INC-33) and SPICe eAoA (INC-34).
Also, who have already filed INC-2 or INC-7 prior to the notification of this change, would be able to resubmit previous versions of these forms (if required) within the stipulated time period.
Further, revised version of INC-7 shall be made available a few days after discontinuation of existing version of INC-7 only for Part I Companies, a company having more than 7 subscribers/promoters, or foreign national subscribers not having a valid DIN. During the intervening period, a separate process of incorporation of such companies will be specified.
It is advised to make note of upcoming changes and to use SPICe eForms only henceforth for new filings so as to avoid the inconvenience at later date upon such withdrawal.
