MCA vide Notification No. G.S.R.936 (E) on Saturday, 1st October, 2016, has notified the Companies (Incorporation) Fourth Amendment Rules, 2016 which shall came into effect from the date of its publication in Official Gazette, unless otherwise stated.
Following amendment is carried on:
- Rule 33(2) has been substituted with new sub-rule, where power of approving alteration of articles is given to Tribunal and also copy of order is to be filed with ROC in Form INC-27 in case of conversion of public company into private company.
- New Rule 38- Simplified Performa for Incorporating Company Electronically (SPICE) is inserted w.e.f.10.2016.
- Under Rule 36, Form INC-29, INC-30 & INC-31 shall be substituted with eForms INC-32, INC-33 & INC-34 respectively.
- New Rule 39- Conversion of a Company limited by guarantee into a Company limited by shares is inserted w.e.f. 11.2016.
