MCA vide Notification No. G.S.R. 1119(E) on Wednesday dt. 7th December, 2016, has notified the Companies (Transfer of Pending Proceedings) Rules, 2016 which shall come into force w.e.f. 15th December, 2016, except Rule 4 i.e. ‘Pending proceeding relating to Voluntary Winding up’, which shall come into force w.e.f. 1st April, 2017.
Rule covers transfer of proceedings relating to:
- Cases other than winding up
- Voluntary winding up
- Winding up on the ground of inability to pay debts
- Winding up matters on the grounds other than inability to pay debts.
